SAND KEY REALTY TERMS AND CONDITIONS
|CHECK- IN/OUT: Check-in time is 4:00 PM. During peak times, please plan to arrive no earlier than 4:00 PM. If the property is available and ready for rental prior to 4:00 pm, an early check-in will be allowed, but note this may not be possible during peak times. We make every effort to ensure your rental is ready at 4:00 PM, but we cannot guarantee it during peak times. Sand Key Realty will only give keys and key codes to the primary guest on the reservation, unless prior arrangements have been made.
Check-out time is 11AM. A late check-out may be allowed, depending on availability. Late check-outs might not be possible during peak times.
Please note that for the foreseeable future Sand Key Realty will NOT be checking guests in at our office. In keeping with social distancing, and to protect our guests and staff, all check-ins will be done remotely via telephone call on the day of your arrival.
Please be prepared to electronically provide a copy of your state issued driverâ€™s license or other acceptable ID so that we can verify your identity and age before you will be provided with any access codes. Please do not attempt to check-in if the primary renter is not at least 25 years old. Your ID will be verified and you will not be allowed to check-in.
LATE ARRIVALS: Sand Key Realty is open from 9:00AM ï¿½ 5:00PM and until 6:00PM during the summer season. All of our guests will be provided an access code to their property before we close for the day and there is no need to notify us that you will be a late arrival. If applicable, keys can be returned to the same lockbox that was utilized during check-in.
CANCELLATION POLICY: Sand Key Realty requires a 25% deposit when the reservation is made. This deposit is based on the total amount owed (including rent, fees and taxes). A credit card on file is required for every reservation.
Cancellations made 30 or more days prior to arrival are subject to a full refund minus a $25 cancellation fee. Cancellations less than 30 days but more than 7 days prior to arrival would result in loss of the 25% deposit. Cancellations are effective on the date written notice is received by mail, fax, or e-mail in Sand Key Realtyâ€™s office. Verbal notice of cancellations is not sufficient.
The remaining balance of your reservation is due and payable 7 days prior to arrival. Cancellation 7 days or less prior to arrival date will result in the forfeiture of 100% of the total stay amount. Reservations made 7 days or less prior to arrival will require payment in full for final confirmation. We strongly recommend purchasing travel insurance to protect your vacation investment. Please note: The credit card on file will automatically be charged 7 days prior to your arrival unless the guest has made other arrangements. If there is an issue with final payment, we will contact you and you will have 24 hours to correct the issue or your reservation may be cancelled by Sand Key Realty with no refund issued. Issues with the final payment do not relieve guest of monetary obligations under this agreement.
THIRD PARTY WEBSITES: Many of our guests book through third party websites (i.e. Flipkey, VRBO, Airbnb). Cancellation policies on these sites may differ and be more or less strict than the policies employed by Sand Key Realty. In a case where the third party site has a different cancellation policy or payment schedule than what we require, guest agrees to abide by the policies of the third party site. All other terms of this agreement shall remain in full effect.
CANCELLATIONS DUE TO WEATHER: Sand Key Realty does not give refunds simply for bad weather or other environmental factors. We do allow exceptions to our cancellation policy if Port Aransas is under direct threat from a hurricane and an evacuation has been ordered by the city, meaning that visitors/residents are actually required to leave the island. A storm that is in the Gulf of Mexico and not yet a threat to Port Aransas, reports of water quality or general rainy/windy weather are not valid reasons to cancel. Cancellations related to COVID-19 will be required to follow our normal cancellation policy unless a local proclamation exists that bans visitors or short-term rentals in Port Aransas.
NO REFUNDS FOR EARLY CHECK-OUTS OR NO SHOWS: Guest agrees that once they have checked in to the property, no refund will be made for early check-outs. If Guest does not cancel the reservation and does not arrive for the Guest's rental period, guest will forfeit 100% of the stay amount.
RESERVATION CHANGES: Changes to a guest reservation (i.e. different dates, different property) are allowed as long as it is 30 or more days prior to the arrival date. If these conditions are met, then we allow guests to change their reservation one time as a courtesy. No additional changes to a reservation are allowed. Changes are not allowed at all once the guest is within 30 days prior to arrival.
WHAT IS PROVIDED:
ï¿½ Kitchens are well equipped with basic cooking needs (dishes, silverware, pots, pans, coffee maker, microwave and large appliances). Note that food products are not provided for safety reasons.
ï¿½ All our properties are supplied with one set of sheets for all beds. Bath towels are supplied per number of people the house sleeps. We do not provide beach towels.
ï¿½ A start up supply of toilet paper (2 rolls per bathroom), 1 roll of paper towels, 2 kitchen trash bags, 1 kitchen sponge, bar hand soap for each sink, dishwasher tablets (if the property has a dishwasher) and 1 bottle of dish soap will be provided. After that, the guest is responsible for any additional needs.
SUGGESTED ITEMS TO BRING: beach towels, extra paper goods (toilet paper, facial tissue and paper towels), extra pillows if you wish to sleep with more than one, coffee and coffee filters, spices/seasoning, bathing soap and shampoo, extra dish soap, extra trash bags, sun tan lotion/sun block and beach gear.
PAYMENT: All major credit cards, checks and cash are accepted. A valid credit card is required if paying cash. You can mail a check in for your deposit no later than seven days after the reservation is made. The final balance may be paid by check as long we receive the check at least seven days prior to the due date. Daily rates quoted do not include applicable lodging tax of 13%, admin/damage fee, cleaning fees and pet fees. Sand Key Realty reserves the right to verify or correct advertised or quoted rental rates and availability that may have been misquoted due to human and/or computer error or to cancel a reservation if there is an error in any of these areas.
AFTER HOURS: Sand Key Realty is available 24 hours a day, with our answering service available outside of normal business hours. Please call us at 361-749-4255. Note that we are available after hours for urgent matters or emergencies only. Please leave a message and we will promptly return your call if it is an emergency. Examples of an emergency are: a guest is locked out, there is a leak in the property, or a danger to persons or property. Messages with routine questions and non-emergency issues, such as issues with Wifi service, will be returned when we open in the morning.
NON-REFUNDABLE DAMAGE FEE:: Sand Key Realty charges a non-refundable administrative fee or â€œdamage feeâ€ with each reservation in lieu of a security deposit. The amount of this fee varies depending on the size of the property. This will cover minor accidental or unintentional damages (as determined in Sand Key Realtyâ€™s sole discretion) up to $500 that occur during your stay, provided any damages are disclosed prior to check-out. Damages in excess of $500 will be charged to the Guest's credit card on file. Damages that are not disclosed to us, stolen items or intentional damage will be charged to the credit card on file. Please note that this does not cover excess cleaning fees, charges for smoking in the property or pet cleanup fees.
AGE REQUIREMENTS: Sand Key Realty only rents to responsible parties 25 years of age or older. The responsible party must be the guest to check in and must be actually staying at the property. Keys/key codes will only be given to the responsible party. A state issued driverâ€™s license or other acceptable ID is required from guest at check-in and must match the name on the reservation. We reserve the right to refuse service.
Please note: Being unaware of our age requirements is not an acceptable reason to cancel a reservation. Our cancellation policy would still need to be followed in order to get a refund. Any underage guests that attempt to check-in will not be allowed to stay and will be held responsible for 100% of the stay amount.
PARKING: Guest agrees to use only the parking spaces reserved for the property and to not exceed the maximum allowable number of vehicles. No parking on empty lots or in neighboring spaces. Street parking is not allowed unless specifically mentioned otherwise in the property description. No RVs or campers are permitted at any of our properties. Boat trailers are not allowed unless specifically mentioned otherwise in the property description. Violators will be asked to leave without a refund. The online property description details how many vehicles your property can accommodate. For your convenience there is a pay by day parking lot on Beach Access 1A by the "On the Beach RV Park" for additional vehicles.
OCCUPANCY LIMITS: Occupancy limits are posted on our website and confirmed at the time of reservation. Guests violating the agreed-upon occupancy limits will be asked to leave without a refund for any remaining nights.
NEIGHBORS: Please observe any no trespassing signs for adjacent properties. No loud music or parties outside after 10 PM. Please be respectful of your neighbors. Any violators will be asked to leave without a refund. Any use of the dwelling other than residential use during a family vacation (i.e. events, bachelor parties, weddings, etc.) must be approved in writing by Sand Key Realty.
PETS: Pets are only allowed in pet friendly properties. Violators will be asked to leave without any refund of unused nights, and will be charged a $500 clean up fee. A maximum of two pets are permitted and pets may not exceed 50 pounds in weight. A one-time, per stay pet fee will be applicable to any Guest bringing pets to a pet friendly property. Please let us know if you plan to bring a pet and this charge will be added to your reservation cost. Pets must be crated if left alone inside the property. Failure to pick up any pet waste will result in a $50 fee. Pets are not allowed in pool areas and must be leashed at all times when outside.
SMOKING: Smoking and/or vaping is not allowed inside or outside any of our properties. Guests will be financially responsible for any damages and extra cleaning, if applicable, due to smoking in a Non-Smoking designated property. If evidence of smoking exists, the Guest credit card on file will be charged an additional $500 fee. An additional $100 grounds cleaning fee will be charged for cigarette debris left by Guest and/or Guestâ€™s invitees outside the Property.
PRIVATELY OWNED PROPERTIES: Guest acknowledges that each property is individually owned and furnished by the owner. No additional furnishings or equipment will be provided.
ï¿½ Within each property, some garages, closets, or cabinets may be locked or inaccessible. These areas are for the property ownerâ€™s use only and off limits to guests. You will be charged for breaking and entering private property if you attempt to break into the property ownerâ€™s area.
ï¿½ Sand Key Realty will make every effort to repair AC unit or other major appliances should they become inoperable, however we can not guarantee the time required to make repairs.
ï¿½ Every property has cable or satellite TV and most have internet service. This service is provided by the owners through a 3rd party provider. We cannot make any guarantees as to the speed or reliability of the internet connection or television signal. If there is a problem, please report it to us and we will make every effort to troubleshoot it with the service provider.
ACCOMMODATION SUBSTITUTIONS: Guest understands that in the event the vacation accommodation is sold by the owner or there are unforeseen circumstances (ie: natural disasters, scheduled or unscheduled construction, flood, damage to the unit caused by construction failures, plumbing, electrical, pests, double booking, etc), Sand Key Realty will use its best efforts to provide a comparable property. If Sand Key Realty is unable to provide such accommodations, then at the option of Sand Key Realty or the Guest this Agreement shall be canceled and terminated. Sand Key Realty shall refund to Guest all payments made by Guest under this Agreement, and Sand Key Realty and Guest shall thereafter not have any liabilities or obligations to the other arising out of the unavailability of the rental property and/or Guest's travel arrangements. It is hereby agreed that these are the only two alternatives (substitute or refund) and the sole remedy for any and all damages, liability or inconvenience arising out of failure to make the premises available.
SELF CATERING: All of our properties are self-catering. No maid or towel service is provided during your stay.
REPAIRS/CONSTRUCTION: Even the best or newest equipment occasionally malfunctions and cannot be guaranteed 100% of the time. Problems are corrected as soon as humanly possible. Refunds will not be issued due to malfunctioning equipment.
Sand Key Realty and its staff reserve the right to enter the rented properties at any time for any purpose connected with the repair, care, or maintenance of the Property. Every effort will be made to contact guest before doing so.
Please do not turn away service providers such as landscaping, pest control and pool companies. They have normal maintenance schedules and this can cause issues for future guests. We reserve the right to charge a guest $100 for turning away one of our service providers.
All of our properties receive monthly pest control services. With our humid tropical climate it is still possible to see the occasional bug despite our best efforts.
Please note that Port Aransas is a growing resort area with surrounding properties occasionally under construction. Guests will not be moved or refunds given due to construction noise.
AMENITIES: Some properties may have special amenities on the property or access to special amenities (including but not limited to roof decks, hot tubs, spas, swimming pools). Unless otherwise posted, guest is allowed reasonable use of these amenities during their stay. Guest recognizes that there are inherent risks in the use of these amenities, and agrees to use said amenities in a safe manner. Guest agrees to assume sole responsibility in relation to these risks and is solely responsible to any damages to these amenities caused by Guestï¿½s misuse or negligence.
Note that Sand Key Realty does not maintain community swimming pools or other common areas. If there is an issue, please report it immediately and we will contact the community manager. Sand Key Realty may not issue refunds for non-functioning or closed amenities.
During your stay, promptly report any maintenance problems to Sand Key Realty by phone during office hours or after hours via email at firstname.lastname@example.org. No refund or rate adjustment will be made for unforeseen failures including, but not limited to, the supply of electricity, water, pool filtration systems, air conditioning, telephone, television, cable, or internet services, and appliances.
PERSONAL PROPERTY/VALUABLES: Lock all doors when you leave your property. Do not leave money or valuables unattended. Neither Sand Key Realty nor the property owner will be held liable for any thefts. Thoroughly check all drawers and closets before departing. If you leave an item behind, we will attempt to locate it and mail it back to you for a $25 fee plus postage. When the Guest vacates or abandons the property any personal property left behind on the premises shall be deemed abandoned by the Guest and Sand Key Realty shall not be held responsible for said property.
HOLDOVERS Guest agrees not to â€œhold overâ€ or occupy the Property beyond the approved checkout time on the date of departure without the express prior written consent of Sand Key Realty. Due to the nature of vacation rentals, Occupant agrees and acknowledges that any unauthorized holding over could cause Sand Key Realty to breach rental agreements with other guests; cause significant losses of rental income and damage to Sand Key Realtyâ€™s goodwill and reputation; result in significant relocation costs in securing alternative accommodations for impacted guests; and/or interfere with critical services, improvements, or repairs. Occupant acknowledges that all costs incurred due to a Hold Over will be charged to the Occupant and may constitute intentional/ tortious conduct giving rise to claims for punitive damages. If the Guest holds over in possession after the Guest's stay has expired the Guest agrees that there is no landlord tenant relationship established by this Agreement and an immediate eviction will occur. In the event of a holdover, any personal property of the guest left in the property will be treated as abandoned property.
GUEST RESPONSIBILITIES: While there may be numerous occupants of the Property during the Rental Period, only the Guest(s) signing this Agreement will be held responsible by Sand Key Realty for payment of the Rental Amount, any additional fees, and all other Leaseholder responsibilities enumerated in this Agreement. Any BBQ grills must be cleaned by the Guest prior to departure. A $35 fee will be charged to the credit card on file for charcoal and food removal or grate cleaning. A $25 fee will be charged to the credit card on file for excessive trash. Excessive trash is anything that has to be hauled away because it will not fit in the provided receptacles. In properties with individual trash toters, please note the trash days and set the toter out by the street so it can be picked up. We reserve the right to charge $75 for toters not placed correctly.
OTHER FEES: There will be a $50 charge for lockouts, extra keys or non-returned keys. A $500 fine will be charged for smoking in any of our properties. Each property is inspected prior to arrival and upon checkout. Properties that are left excessively dirty will be charged an additional $30/hr cleaning fee. Any missing items from the property will be charged at the actual cost of replacement. Late check-out fees vary based on the size of the property and how late you would like to check-out.
PENALTY FOR VIOLATION OF THIS AGREEMENT:
If the Guest violates any of the conditions or restrictions of this Agreement, Sand Key Realty reserves the right to terminate this Agreement and enter the Property. Upon notice of termination of the Agreement, the Guest and all invitees shall vacate the Property immediately without being entitled to any refund
NO ORAL MODIFICATIONS: This Agreement may not be modified, amended, or terminated orally. No modification, amendment, or termination, or any waiver of any of the provisions of this Agreement, shall be binding unless same is in writing and signed by the person against whom such modification, amendment, or waiver is sought to be enforced.
NOT A LEASE: This is a vacation rental agreement for a temporary vacation stay at a managed vacation rental property. THIS AGREEMENT IS NOT A LEASE AND CONVEYS NO RIGHTS IN REAL PROPERTY. By agreeing to the Terms & Conditions, you stipulate and agree that you have not and will not receive a real property interest in or rights to the vacation rental property.
NO ASSIGNMENT: Guest may not assign any part of this Agreement. Any attempted assignment, sublease, or grant without the written consent of Sand Key Realty will be void.
LIABILITY: Guest agrees to indemnify, save, protect, defend and hold harmless Sand Key Realty, Sand Key Vacation Rentals, itï¿½s agents or assignees, and the owners of the property for any and all claims, actions, suits, demands, damages and costs related to defending same, including attorneyï¿½s fees incurred as a result of any injuries to persons or damages to property, including any damages that are the result of the negligence of Sand Key Realty, Sand Key Vacation Rentals, itï¿½s agents or assignees, and the owners of the property; any damages that are the result of Sand Key Realty, Sand Key Vacation Rentals, itï¿½s agents or assignees, and the owners of the property being sued for as a result of the acts or omissions of Guest or arising out of the acts or omissions of Guest. Sand Key Realty and its staff reserve the right to enter the rented properties at any time to inspect the property or perform routine maintenance. Every effort will be made to contact guest before doing so.
GOVERNING LAW; VENUE: This Agreement was negotiated in, entered in, and is performable in Nueces County, Texas and shall be governed by and interpreted in accordance with the substantive laws of the State of Texas without regard to its conflict of law principles. The Parties acknowledge and agree that any and all disputes arising from or related to this Agreement or the obligations contained herein shall be brought only in the state courts located in Nueces County, Texas. All parties to this Agreement consent to personal jurisdiction in Texas.
ELECTRONIC SIGNATURE AGREEMENT: Both parties agree that this agreement may be electronically signed. The parties agree that the electronic signatures appearing on this agreement are the same as handwritten signatures for the purposes of validity, enforceability and admissibility. By selecting the "I Accept" button on Sand Key Realtyâ€™s company website or a 3rd party website that Sand Key Realty has utilized to advertise the property, you are signing this Agreement electronically. You agree your electronic signature is the legal equivalent of your manual signature on this Agreement. By selecting "I Accept" you consent to be legally bound by this Agreement's terms and conditions.
THIS IS A LEGAL DOCUMENT. READ IT CAREFULLY. IF YOU DO NOT UNDERSTAND THE EFFECT OF ANY PART OF THIS AGREEMENT, SEEK LEGAL ADVICE.
